according to the 6 o clock news on rte1, a guy convicted of having around 16,000 pictures and videos on his pc of infants being abused got a 4 year suspended sentence, do one critisise the judge, or does one applaud his defence team, it seems he was employed by the artichureural department of cork city council, he got/took early retirement, which one must assume includes a nice little pension, what a lovely deterrent.:mad:

**** the guy with child porn, jail the god damn judge who'd give out a sentence like that, he's the real danger to society.

    http://www.rte.ie/news/2009/1113/iversd.html
A 54-year-old former local authority official has received a four year suspended sentence at Cork Circuit Criminal Court for having what was described as 'some of the worst and grossly offensive' images of child abuse in his possession.

Judge Patrick Moran told David Ivers, of Rathcoursey, Midleton, who had pleaded guilty, that his reaction when he viewed some of these 13,845 images was one 'approaching horror'.

The judge said these children were very seriously violated by people benefiting financially from people like Ivers downloading these images and he did not know what long-term effects they would have on their future.

But having read the reports from the Granada Institute, Ivers own psychiatrist, and his elderly mother's GP, as well as hearing from gardaí that he did not pose a threat to the community, the judge handed down a four year suspended sentence on condition that he continue under the direction of the Granada Institute for two years and allow gardaí to visit his home when they see fit.

Investigating gardaí alerted by the owners of German website Carookee.com discovered 13,845 images of child abuse on his computer as well as 1,834 movie files.

Ivers, who was described in court as having suicidal tendencies, is the sole carer of his 84-year-old widowed mother.

Employed by Cork City Council for 30 years, he was chief technician in the Architect's Department until the case first came to light and he has since taken early retirement.

For the people who want to read it.

Castrate him I say, then he won't have sexual attraction and therefore no threat. Maybe a prison term of 10 years too.

did you hear part of his defense?
if he was put in jail his mother would be "sad and lonely"
Noone gives a shít about your mother! (apart from that gobshíte of a judge..)

fúcking bástard..hopefully karma catches up with him. sick sick cúnt.

Yeah shocking stuff. Got suspended because he was suicidal and was his mothers carer. So carers all over the country can now safely look at child porn with kids under the age of one, save 16,000 images and nearly 1,800 videos and get away with it if they say they're suicidal.

    Horrible.

Holy ****, there must be some serious amount of child abuse behind that much material.

I've said it before and unfortunately I'll have to say it again.

    'Suspended Sentence'

The two most popular words in the Irish Justice System.

Now contrast that to the Dutch guy getting 3 years for growing a little hash in his house last week.

FFS, this is the problem with allowing Judicial Discretion.

It is in no way a consistent enough basis to build a legal system on.

OK, they've got four years to use his house as an unofficial club-house. Call around every evening with a few cans, set up some amps and a pool table, and party till dawn. It's a hell of a deterrent, and as a bonus his mother won't be lonely any more.

Maybe that judge was wiser than he seems.

It's pretty sick alright but, and I know I'll be called a no good pinko for saying this, but what is it that makes AH better than a judge and the Gardai in deciding what sentence someone should get?

The Gardai said he poses no threat to the community, so what is castrating him gonna achieve?

I do think he should have got a non-suspended sentence though

when i heard that story on the news today..my first thoughts were how fu*ked up our society has become.

At what point does one become so depraved that the qestion of total removal from society is required.....

How can a judge form a considred opinion that a 4 year suspended sentence is sufficient to protect society from a person who gets sexual gratification from looking at children as young as 12 months.

I'd say he'd rather have had a slap on the a*se.

When I see sentences like this being handed out by judges a part of me becomes very suspicious of the judge to be honest.

I know I've said it already a few posts back, but I have trouble getting my head around the amount of stuff he had. I always assumed when I read articles about pedos that it meant a few pictures or something. I always assumed it was too underground to be so widespread. 1,800+ videos is just a staggering amount for someone to collect before they were noticed.

A person does not need a law degree or to be trained as a police officer to determine what is right and what is wrong. Anybody reasonably balanced, caring and an intelligent person will realise that this sentence is wrong. That is the problem. The judical system is out of kilter with reality and public justice.

I gotta lean slightly this way, although I disagree that the Gardai saying he poses no threat to the community should of been taken into account but going to prision could have been an easy let off for him, a few months inside to let things blow over verses having your face broadcast on national news to ensure that the guy has a miserable existence in the community and also will hopefully have some degree of fear as he goes about his everyday life.

In cases like this, I think the person should have an extremity chopped off.

4 years jail itself would have been a joke but suspended? Madness I say.

  • Closed Accounts Posts: 9,534 ✭✭✭SV

So they say he has almost no chance of reoffending..and by that give him a suspended sentence.
Isn't that in effect giving him no punishment whatsoever?

We need someone pushing a Jessica's Law like Bill O' Reilly did in the states

    http://www.billoreilly.com/outragefunnels

"Among the key provisions of the law are a mandatory minimum sentence of 25 years in prison[2] and lifetime electronic monitoring[3] of adults convicted of lewd or lascivious acts against a victim less than 12 years old."

We also need someone to ask these judges why they give so lenient sentences when they don't have too

Unfortunately, castration does not stop the sexual desire. The urge is still there. Apparently he posed no threat anyway, but to have such vile images on his computer surely warrants a long term jail sentence?

He might pose no threat, but he is a consumer of material whose production is child abuse. So he promotes child abuse, that's how I see it.

I agree completely. And how long before perving on the images is no longer enough? That's why he needs to be jailed, properly punished for this.

It's disgraceful all of the sentences that have been handed out by Irish judges in child abuse/child porn...in fact I can't think of one case where the scumbag got a deserved sentence.
Something is seriously wrong with the irish law system.

so what if he suicidal....we dont need people like him

    lock him up i say...

its not like he seen child porn by accident...he had 14,000 videos and pictures ffs..... and some of them with kids as young as 1

Should have gone to jail. OK so it was just images that he had nothing to do with but he encouraged it by his downloading. Technically he was not a pedo but broke the law.

Should have gone to jail IMO.

You break the law you do the time.

While I disagree with what he's done. He hasn't actually abused any children himself (that we know of). So let's cool the jets here yeah?

However, he hasn't helped matters by putting money (we assume he paid for it?) into the hands that do abuse children.

I think the fact that he has to be amongst people who know exactly who he is and what he is is close to punishment enough! In fact, I wouldn't be surprised to see in the news in the near future that he's taken a beating!!
