    Its about letting the Eircom Directors [off the hook] once again, another toothless wonder, useless for obtaining real competition in the ISP service provider fair competition fiasco.:confused:

    This is the "New Regulatory Package" that was discussed around then. Mary O Rourke said in the Dail that it would contain regulations that would allow ComReg to impose FRIACO and lower the cost of bitstream wholesale. This prompted an examination of the new regulations as well as the existing ones.

    (a) local, national and international telephone calls,
    (b) facsimile communications, and
    (c) --->>>>data communications at data rates that are sufficient to permit functional Internet access,

    At least we may be able to throw this in there face when they insist they only need to maintain the line for voice calls only at a sh**t baud

    The EU directive is to be turned into Regulations by national regulators.

    In the UK, Oftel Decided that the minimum data speed on all analogue lines should be 28.8k Pages 20-25 and again on 58 to 63 lest any carrier be mistaken about precisely what they meant.

    In Ireland , faced with the same EU legislation and a co-operative Rat (as usual) Comreg decided that the E-Tub of Europe ®®שׂﭙ™™ should have a minimum data speed of 0k (down from 2.4k) although that has not been finalised yet, see pages 23-28 of the DRAFT regulation Here and compare it with the much more practical and modern UK one. Note where they said they would not set a minimum data rate on page 26 and 27 even though 19.2k may not be satisfactory .... hence it is 0k

    Comreg will not require that Eircom inform their staff of the existance of the USO either which would be a help of course!

    If you feel that Comreg are wrong in deciding that Functional Internet Access is possible at 0k then please tell them yourself.

    Probably worth having a look at ComReg's proposals in anticipation of this here. Go to page 23.

    I just got an answer back from Comreg referring to my complaint ...:
    Dear Mr X

    Thank you for your comments which have been passed on internally.

    ComReg has set out its approach in relation to functional internet access in Document 03/68 (Section 5.1.2.3) and in the subsequent Decision Notice (Document 03/87). A specific functional internet access requirement is not specified at this time. ComReg has directed that eircom

    (1) develop a statement which sets out the range of factors which can affect its network performance (and are within its control) and therefore the speeds enjoyed by internet users
    (2) inform ComReg of the number and location of connections to the public telephone network that employ carrier systems/pairgain devices.

    Following further discussions with ComReg, eircom are to develop a plan for addressing network performance issues that affect the speeds enjoyed by internet users. ComReg has reserved the right to specify any further actions that may follow, including further specific measures regarding functional internet access."
