    ComReg said it has agreed to the terms of an audit of Eircom, which will be carried out to determine if the incumbent is illegally undercutting its competition.

    ComReg said that since the terms of reference for the so-called "Independent Compliance Audit" had been agreed, the investigation into portions of the former monopoly's books and pricing procedures is set to begin no later than 20 October 2003. The final report is due to be delivered to ComReg by 31 January 2004, although it could be delivered earlier.

    In the report, an independent auditor, which will be selected by Eircom and approved by ComReg, will deliver an opinion as to whether Eircom is meeting certain requirements that relate to what it charges business customers. The report will be the first to be produced in a process that will repeat every two years, a process that was initiated by the ODTR last year to ensure that Eircom was not breaking regulations.

    At the heart of the matter is what's known as "off-book" pricing, which is essentially offering discounts, which are below publicly stated prices, mainly to large customers. Last autumn, Eircom admitted that it had given some customers inappropriately large discounts, but insisted it was a technical error and not a deliberate breach of competition law.
