Penalty points system 'may be challenged'

Drivers who are genuinely unaware of defects to their vehicles, may be able to legally challenge the issuing of penalty points under certain circumstances, according to a British transport lawyer.

Johnathan Lawton addressed the annual conference of the Irish Road Haulage Association, saying drivers should not be responsible for defects to a vehicle, if the damage took place in transit.

Mr Lawton feels some aspects of the present legislation are flawed, and is convinced motorists are being punished unfairly in some cases.
