    Most of it is dreadfully boring , all of it pedantic in the extreme. 2 Mb 76 Page PDF here. .

    They are drivelling on about Local loops generally in order to establish at stage one (of 6 stages) that Eircom have Significant Market Power.

    3.23 There are a number of potential demand-side substitutes at the wholesale level.
    Cable infrastructure, which has coverage of approximately 87% of Ireland, could
    over time provide a substitute to the metallic local loop. However, this would
    require substantial investment and is unlikely within the timeframe of this current
    review. Given the existing state of the cable networks it is not possible to offer a
    functionally equivalent substitute to the local loop in the timeframe of this review.
    As much as 90% of cable connections cannot provide access to support the
    provision of data services at all. Of the remaining 10%, there are fewer than 4,900
    subscribers and services are spread across areas of Limerick, Cork, Dublin,
    Kilkenny, Tipperary, Waterford and Longford,
    thus limiting any competitive
    constraint that could be exerted on the local loop within these areas. This is not
    expected to change within the timeframe of this review.

    I'm sure its news to Cork and Limerick that Cable BB is available in those Counties, it is to me too.

    Page 26 , they repeat this again word for word , dunno why seeing as it was wrong anyway.

    If the rest of their stated assumptions are as weak then €ircon will gleefully haul them into the High Court for the inevitable chalenge. Expect stage 1 to finish next year and rock on stage two. LLU by 2010 , probably.

    According to yesterday's Irish Times Comreg has ruled that Eircom has Significant Market Power in the market for wholesale unbundled access. The article also notes that

    This wholesale access price has been the subject of a bitter dispute between Comreg and Eircom for more than a year. The dispute went to the High Court last year.

    A settlement was later reached enabling Comreg to perform a pricing review. A decision on the price is expected shortly


    And no doubt if it is not to Eircom's liking its back to the Four Courts....
