    Dermo,

    seems to be losing the plot completely, this appeals panel will only delay any real decision making as the Teleco's appeal any ruling that the bastion of decisiveness Comreg get round to making.

    If the Teleco's don't get the result they like they head off to the Four COurts anyway.

    This is typical of the current Government.... why make a decision when you can postpone it and then blame someone else ?

    The appeals panel was set up under S.I. 307 of 2003, an SI which transposes a EU directive

    Hugh Mohan is a surprising appointment - Chairman of the Bar Council, hard working and very ambitious. Short biog below. OBrien and Heneghan are both Junior Counsel. By Regulation, the Panel must have 3 members, one of whom must be a lawyer. In appointing exclusively people with a legal background it would appear that the Minister is attempting to establish the panel's credentials and give it clout. It could also be interpreted as reinforcing ComReg's brief as the technical arbitrator, leaving this panel for appeals on legal points rather than technical ones. Of course, the option to go to take the court route remains.

    And according to this recent article (bottom of the page) Vincent Brown would have us believe that Hugh is a card carrying member of the Communist Party of Ireland (Marxist-Leninist) and that this contributed to his recent elevation to the position of Chairman of the Bar Council. (Actually no, I got that wrong, amazingly enough his affiliation is with Fianna Fail and this had nothing to do with is recent elevation to the position of Chairman of the Bar Council ) One would have to conclude that he is well on his way to stint on the High if not Supreme Court.
