Certificate of Compliance trouble

    Hi,

    We're buying a new house, for which the certificate of compliance has been completed by an architectural technician. While it appears that arch. techs can complete these, the other side's chap has not been practicing long enough to do so.

    We don't believe there's anything wrong, btw, just typical builder disorganisation.

    Can another engineer create a certificate of compliance, so that our solicitor can in good faith give the correct undertaking to the mortgaging bank? More to the point, can we pay an engineer to do so, and cut out the interminable wait?

    I think they should hire and engineer, preferably one who knows the builder's form and who can verify things as best he can. They might need a few holes dug to look at foundations, but thats their problem. I imagine it will cost them 1,000-2,000 euro extra, because to a certain extent the new engineer is taking a risk.

    Hi,

    Yes, we're getting homebond, and the builder is competent: the real issue is compliance with planning, which may lead to problems if we're selling. We don't believe it's not compliant.

    Is there a retroactive search that can be done to deal with the issue?

    Do you mean planning permission? You go to the council office, ask for a copy of the file (you will have to pay for the drawings) and compare PP to site.

    Its something anyone should be able to do for a few hundred euros.

    Is the house in Youghal?
