    Not that it makes a damn bit of difference what the ASAI say or think but its interesting still:

    ...The advertising, which ran at various times during 2005 offered broadband for €35 including free line rental to the 1st 100,000 customers in 2005. The complainants all of whom registered for the service during 2005 (from March onwards) and who had their telephone services switched to Smart Telecom as a result, had at the time of complaint, at least 6 months later, not received the Smart Telecom broadband service and consequently were unable to avail of the free line rental offer. The complainants said that despite numerous contacts with the advertisers they were unable to ascertain when the service would be available to them...
    The Complaints Committee noted the response of the advertisers. They accepted that the advertising clearly stated that the offer of free line rental was contingent on the customer having the advertisers’ broadband service. However, in relation to availability of that service, they noted that the advertisers had not demonstrated that they were in a position to meet the demand created by their advertising. They upheld the complaints

    I take it Smart will be abiding by the ASAI's ruling and removing/changing the ads so that they are in line with the Advertising rules?

    I would say that these complainants are in places that were 'coming soon' like Loughrea in Galway or Oranmore ...but which were kicked off the network build plans in the latter bit of 2005 becuase of all the grief Smart got from eircom in the day to day LLU process.

    They have a justifiable complaint . Smart should amend their ads to make it clear that they only supply this offer in "certain parts of Large Cities only " and they would be compliant.

    Smart should also email all of those knocked off the network build with an explanation as to why they will not get LLU for the foreseeable future

    Sounds like they fell for the salespersons BS aswell. "Sure why don't you switch your calls over to us while you're waiting".
    Little did they know that even if Smart BB did become available to them, they would have to switch back to Eircom before they could get it.:rolleyes:
