Issues with a Builder.

    Ok, we bought a house in Sep last year in where it was built up to roof level, roofed and tiled etc. The auctioneer told us all we had to was pay the deposit of 5000 and then the rest upon completeion. So that was great, or so we thought. A few weeks later the builder hit us with stage payments and was looking for the amount that the house was built to. 155000 to be exact. So we had to go and change our mortgage drawn down to stage payments which took some time. Only in the meantime having the builder screaming at us, blashpheming down the phone etc looking for his money. So in the end he got his money and we got a 6 month contract.
    Contract was up on May 30th in where at that stage all that had been done was plastering and hardwalling on the inside. Builder met up with us to sweet talk us and said whatever ye want done extra, let the foreman know and we will accomadate you. They never did!!!!
    Anyway the house is still not complete, 4 months over contract and looks like it will go to 6 or 7 months. The builder is totally taking the piss and we are paying 97% of our mortgage along with rent. We are threatening him with court action for compensation of rent and others. Was just wondering has anyone gone thru a similar process and succeded?

    if the contract has explicit deadlines then talk to your solicitor as long as you did not 'change' anything thereby varying and delaying the contract

    Hi ya. No have not moved in yet. Was hoping to be in by xmass but its not looking like it now. At the rate they are finishing the house the snag will take over a month. And trying to get tilers and floor fitters around the dec period will be a no go. At that stage the builder will be 6 months over contract. Solicitor has advised that we have a case alright but they have ignored all letters that were sent some while back....
