    Anybody know when the next AGM is? I couldnt make the first one in the Golf Club but want to attend

    Wise charged over 30k for there fees for a year ....it will be interesting to see how they justify that!!:rolleyes:

    A lot more interesting things than that look at the debtors total have they been chased up does it mean the rest of us have to pay more next year to pay for the short fall.The sinking fund how do the houses benefit from this its not stated anywhere why should they have to pay for it .The council cant take over the estate as they say Ballymore still own two properties.Has any effort been made to sell these so the council can take over the roads sewers lighting and other services therby reducing the overall running costs then the fees levied.The council say they are willing to do so but nobody has officially approached them in relation to this.
    Iknow some are worried about building a wall along 3 trouts and think the management company should do this well ballymore are under no obligation to do this nor are the management company.I asked a property developer for arough guess how much it would cost its .9 of a mile he reckons 1.8 million euro and the foundation would cause drainage problems and it was doubtful planning could be got.Also Charlesland park would have to be got on board to complete it methinks its a waste of time pursing this when other more pressing administration matters such as company structure and councoil takeover are a priority

    As I understood it, at the Grove / Park AGM, our management company said that planning permission for Charlesland was given subject to the council not having to take over the estate, so it is unlikely they will do so anytime soon.

    A sinking fund is a contigency fund for any expensive pieces of work down the road. It is pretty standard to have one of these.

    Section 180 of the Planning and Development Act 2000 contains a new provision for taking in charge of housing estates including apartment blocks by local authorities as follows:-.

    Where a development for which permission is granted under Section 34 or under part IV of the Planning Act 1963 and which includes the construction of two or more houses and the provision of new roads, open spaces, car parks, sewers, water mains or drains and the development has been completed to the satisfaction of the planning authority in accordance with the permission and any conditions to which the permission is subject, the authority shall, where requested by the person carrying out the development or subject to certain conditions by the majority of the qualified electors who are owners or occupiers of the houses involved as soon as may be, initiate the procedures under Section 11 of the Roads Act 1993.

    Bertie, I believe the 2 properties are conveniently tied up with planning issues so can't be sold.

    Regarding the debtors, we are entitled to see a list of residents who have not yet paid (more relevant would be a current listing as opposed to the 2005 year end one) - Everyone request this form Wyse prior to the meeting. Question the Directors as to whether they personally own any of the units and whether all management fees due have been paid up (same applies to any units owned, rather than unsold, by Ballymore)

    Proposal for meeting - Use the sinking fund to pay for professional advice regarding the removal of Ballymore directors from Board and Estate!!!!! The sinking fund will be largely irrelevant when (not if) the council take over the estate. Try and imagine how the sinking fund would be returned in five or ten years time when it is no longer needed and ownership of units has changed a number of times over the years.

    And Bertie, you're spot on about the wall. Never going to happen. And besides, would a wall really keep out those that it is supposed to? Stick to the relevant issues at the meeting and it will be much more productive!
