Accepting contract with company, and breaking before you start work?

    Hey,

    With the milkrounds just around the courner I was recently asked by someone what would happen in the following situation.

    Nov 06 - Candiate A receives job offer and contract from company B

    Dec 06 - Candiate A accpets offer and signs Companys B contract. The candiate is due to start with company B in June 07.

    Jan 07 - Candiate A receives offer and signs contract from Company C.

    Candiate A then informs company B that he will not be starting in June 07.

    Im sure its a common enough occurance, and obviously I know the theory (that its a broken contract, damages only for whatever loss can be shown etc etc) BUT does anyone know what happens in reality?

    Generally nothing happens. The sooner candidate A contacts Company B to inform them that he has changed his mind the better for both the Company - they have time to find someone new and also the candidate - there won't be any hard feelings from the company.

    Company B can't get specific performance since it's not granted for employment contracts. Theoretically they could get damages but 99.9999999999999999% of the time a company could not be bothered

    This is just an "overhead" to a compnaies hiring expenses. Just annoying, but nothing will be done at normal level of employment,

    Also, the B contract would have likely only had a commencement date of June 2007?

    Say hypothetically ABC accepted a short term contract say 5 months with The Firm and wanted to break it after 3 becuase they're offered better/permanent job in The Company XYZ.
