Rats in Rented House

    Apologies if these should be in accomadation please move if you have to.


    We got a letter from our Estate Agent yesterday addressed to everyone living in the house. We had recently informed them that quite a large family of rats have moved in and have eaten their way through about 100Euro worth of poison so far.

    Dear Housemembers,

    Rodents are a very serious problem. We "recommend" you contact (PestControlCompany)(And their phone Number) as soon as possible as this is a very serious situtation.

    What im wondering is, do we actually have to pay for these Pest Controllers to come in or is it the duty of the landlord to make this happen. Im renting a double room for the last 4 months, the house is a total kip and they have made no effort to improve our living conditions.

    What we want to do is order in PestControl and then send the bill up to the estate agents. However we are concerned werther or not such action would bring legal implications against us and maybe we will have to kiss our deposits good bye. Ive never signed any lease in the house, ive never actually signed anything since ive moved, nor has any resident in the house and we are at a loss as to what to do. can anyone advise us??

    Im gonna do the convenient thing and assume you don't seek/give professional/credible advice, and are using the forum only to speak in the hypothetical? Excellent, lets continue ;)

    Given such a situation, I would run!? ARE YOU CRAZY PUTTING A DEPOSIT DOWN WITH NO LEASE!?!?!?

    rule number one: 'Pen' before 'Penny'. They shouldn't get a damn cent until you sign a lease.

    How much is your deposit in comparison to rent? I advise skipping your next payment and getting outta there: kill off whatever standing order you have with them, because theres no contract they *should* (stressing Im not legally edumacated..yes, ed-u-ma-ca-ted) *should* have no legal power to sue you for so-called "outstandings"..course, theres always that whole oral contract snag...

    I do believe Irish Law places minimums on anyone who Leases; Oral contract or Otherwise: If they are renting out, they have legal obligations.

    One of them (obviously) is keeping their goddamn property up to code.

    Tell them the property is not safe to live in and you wish to leave. Your deposit should be fully refunded. Speak to them hypothetically about it first, and if they stone-wall you, throw legal voodoo at them (gotta love that sh**)

    Tricky one, but what I WOULD NOT do is collect up a dead rat, everytime one passes on to rat heaven, and deposit it on the estate agents reception desk and say, politely, "we found another one, how did you say we get rid of this problem?" ;)
