    EC opposes Polish regulation of retail broadband

    The European Commission has asked the Polish regulator UKE to withdraw its proposals for regulating retail broadband services at incumbent TP. The commission already earlier expressed doubts about the market analysis backing the proposals and said it is not convinced by further evidence offered by the UKE. Noting no precedent in the EU for retail broadband access regulation, the commission said the regulator's market analysis may be based on an incorrect definition of the market and that retail broadband access is not compatible in terms of pricing and function with the narrowband market. while acknowledging the regulator's concerns about possible anti-competitive behaviour in the retail broadband market, the commission called on the UKE to first impose wholesale regulations before moving to retail measures.
