Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Hmmm I don't have the Vista EULA does any of you actually have it? While eveyone knows the OEMs were originally aimed at system builders, there is no difference between a system builder like Dell and a home builder... they are both assembling a computer from prebuilt components. That's why MS relaxed the rules. Many people might indeed be building systems themselves and be perfectly within the intent of the licence. Microsofts definition of a "System Builder" at least is clear:

"By accepting this license, you agree that you are a
system builder. If you do not open this package, you may distribute it to another system builder. “System builder”
means an original equipment manufacturer, or an assembler, reassembler, or installer of software on computer
systems. If you choose not to accept this license, promptly return the unopened package to your distributor. Individual
software licenses or hardware units cannot be returned after this package is opened."

    And on:

The MS licensing team clarify that there is no difference in licence between a OEM licence that shipped with a computer and one that you purchase after the fact:

"There is no difference between pre installed OEM operating system software and OEM operating system software acquired after the purchase of a PC. Regardless, the OEM operating system must remain with the device that retains the motherboard. To activate Windows XP over the telephone, you can simply call a toll-free number displayed on your screen."

Dunno if its different for Vista that XP though.

    Ah, sorry about that!

In that case Seamas is spot on. If you're going to break the license, you become a pirate, and you might as well (in terms of legality) have just downloaded the software illegally in the first place.

Notwithstanding that MS receive 175€ from someone purchasing Vista ultimate OEM - some 'pirate' that is (!) versus someone who downloads Vista for zero €

It may have been discussed already, but Microsoft attempted to make the retail version of Vista device specific, but appear to have changed their mind at the last minute.

It still contains some pretty obnoxious clauses, in particular the "self help" clause which allos MS to disable some features on your computer on failing WGA.

As for considering using an OEM copy morally objectionable? Only a Microsoft employee could seriously hold that opinion. As a poster mentioned, if you self build, you are the OEM. The only requirment, from my understanding, is that the builder complies with the MS system builder licence:

I don't think I will be upgrading to Vista, ever.
