Licence fee rebate

    As every firearm licence relates to an individual firearm, can the holder of a licence, who disposes of the firearm it relates to (during the licensing period) seek a partial rebate of the licence fee, in respect of the remaining time period of that licence.

    Also, can a firearms licence be legally transferred from one firearm to another, without going through the full application process. If yes what legislation enables that transfer.

    Not sure on the first one ArthurJ, and yes on the second one, but off the top of my head I don't remember if it's just an operational thing the Gardai do or an actual part of the Firearms Acts.
    I know it's law in the UK, just not sure about here.

    1964 Firearms Act Section 11 takes care of the latter. There appears to be no provision for the repayment of duties on a pro-rata basis, although there is a provision for the payment of the value of a firearm where the firearm has been seized and sold.

    11.—(1) Subject to subsection (3) of this section, the Minister may substitute for the description of a firearm in a firearm certificate granted by him the description of another firearm and, upon such substitution, the certificate shall have effect in relation to that other firearm and shall not have effect in relation to the first-mentioned firearm.
    (2) Subject to subsection (3) of this section, the Superintendent of any district or any member of the Garda Síochána in any district duly authorised to do so by the Superintendent of that district may substitute for the description of a firearm in a firearm certificate held by a person residing in that district the description of another firearm and, upon such substitution, the certificate shall have effect in relation to that other firearm and shall not have effect in relation to the first-mentioned firearm.
    (3) A substitution under this section in a firearm certificate shall not be effected unless the rate of excise duty chargeable in respect of a renewal of the certificate after the substitution does not exceed the rate chargeable immediately before such substitution.

    Yes , with some restrictions ...
    Usually if you needed to change from one make/type of DB 12gauge shotgun to another (newer gun ..whatever) it would involve getting a note from the firearms dealer indicating the "Gun-taken in" ..(Your old one) ..and the "Gun-going out" (Your new one) .. Bring the paperwork to your local FO along with your firearm Certificate and he will just amend you existing licence with the new details (Make /serial number) .

    It's pretty much the same procedure any time you look to change more or less same -for -same.

    Swapping a licence from a shotgun to a rifle isn't usually done . One complication to start with is the different fee rate.

    Don't you pay the full annual fee regardless of the initial date of issue?
    Makes me think there is no refund coming at the other end of a licence period.
