    I believe that Seamus Healy has taken legal advice on the validity of some of the spoiled votes. The Returning officer has refused a re-examination of the spoiled votes. This has angered Healy. This may end up in the High Court.

    Seamus Healy might want to look at the spoiled votes but he is barking up the wrong tree. The same argument took up about 3 hours during the Mildred Fox / Nicky Kelly recount. The Returning officer who had serious legals at her side said that she would not revisit them as they were pored over for several hours under scrutiny of all 15 candidates and their agents and there was agreement on what was allowed and not so as far as she was concerned the issue was closed. Kelly had a senior Labour Party barrister who was arguing for it nut no way. 4 other barristers at the count said that the only way you would get to revisit them would be to try get a court order and even then it would probably be thrown out. To break the impasse a sample were "looked at" (not re-adjudicated) but it was quickly agreed that there was nothing there for readmission and the R/O was daring anyone to try anyways.

    From experience of looking at spoiled papers what is left in there are the written on ones, double numbers, no clear preference etc etc.

    If there was 1% spoiled then that would be high and would be 380 votes. If 10% of those were shown to be valid votes that would be only 38 which means 38 votes deemed invalid under the eyes of the candidates.

    The Seamus Healy would want to get all of these in his favour and none to MM. That would imply that Healy was asleep while the votes were looked at originally.

    Dream on. there are far more important places to look for chinks of light at a recount.

    Thanks for that, just couldn't get an answer yesterday about what was happening. Fair play to Mansergh he really deserved it. Still in shock that Mattie McGrath got more votes in the first place tho!!
