    Whats the use in giving them the words to say they can fine if they have no power or will to use it in anyway, atleast OFCOM in the Uk has some teeth and is feared alittle by telco's

    Not sure you get my point.

    Before now, ComReg had power to fine 3K Euro. You're correct they have not been really successful at much.

    My point is though that, per previous posters, unlike Ofcom (who have teeth) ComReg have to use the courts (potentially ex parte) which protect rights but with the correct construction (unlikely) they could be successful in fining once correctly found and supported by a court of law and within the confines and Burdens of Proof required by the Competition Act.

    So we agree sir. Just perhaps a slight loss, maybe in translation.

    I don't think so tbh, on any level. ComReg have never followed through on a court action, they've always backed down. They never will. ComReg has never fined anyone, ever, and they never will. You could give them a flamethrower and a map to Eircom HQ - and explicit permission to use the former on the latter - but it wouldn't do any good. They'd either drop the flamethrower and break it, or they'd lose the map.

    More likely they'd have a consultation on the correct operation of the flamethrower, a subcommittee meeting on the provenance of the map, and then they'd fire the lot into a skip two years later as being out of date and not in-line with current regulatory practice. They're a useless shower <.cg snip> that have done as much damage to this country's technological competitiveness as Eircom.

    (I've dealt with people in ComReg, and they were generally very nice people. Collectively though, see above. There are limits to "working from within". When nothing happens, at all, perhaps it's time to stop.)
