    France Telecom has been fined EUR 45 million by the French competition authority for anti-competitive behaviour on the DSL market. The fine was the result of complaints by T-Online and Liberty Surf in 2001-2002 and puts an end to a series of preliminary regulatory judgements against the incumbent operator. While the company can appeal the fine, it has agreed to not contest the allegations with the regulator in order to secure a reduction in the amount of the penalty. The competition watchdog said it had originally increased the amount of the fine by 50 percent due to previous repeated infractions by France Telecom. The company is accused of abusing its dominant position on the local access market by favouring its own ISP Wanadoo and hindering the development of alternative DSL providers in France. Earlier this year a court upheld a fine of EUR 10.35 million imposed by the European Commission on Wanadoo for similar offences.
