Its always been the law that provisional drivers are'nt allowed carry passengers. Had to laugh when I heard women phoning radio stations saying that they could'nt bring their kids to school any more. They never could legally. The only person as was mentioned before that you can have in the car is your "supervisor".

Are you saying it is illegal to carry other passengers as well as the supervising passenger?

Aww poor them. It's like armed robbers who forget to bring bullets, I always feel sorry for them.

I was being sarcastic..... S50 and s49 have the same practical effect.

Where did this law come from? I've never seen it.

What if I was in a car with an L-driver and I don't have my license? Could I just say I don't have a license and get away with it? What happens if the passenger genuinely doesn't have a license? Do they get points on their ghost license? What if there's more than one person in the car as stated previously?
If the driver is charged with driving unaccompanied and says that the passenger was supervising it is a question of who will be believed. If he gives the name and address of the passenger to the guards they will soon find out if the passenger has a licence. If the driver takes the rap the passenger is fine. If not the chances of someone who has a licence sitting beside the driver of a car with L plates on it being able to maintain that they were not supervising is remote.
If there are no L plates on the car the passenger can say he did not know he was in a car being driven by a provisional licence holder and had no intention of supervising. If a licence is demanded of the driver and the driver hands over a provisional licence on the spot, the passenger will have to declare himself as the supervisor or both passenger and driver will have to leave the car where it is.
