    OP, I work in insurance and we get car parks to put up the disclaimer signs to try prevent people claiming. You can claim from the car park operators, sned them a solicitors letter. I see lots of claims on car parks for damage to cars. Most insurance companies would pay but if it's Quinn Direct insuring it you'll have a battle, they're tight C U Next TuesdayS and that's why their cheaper. PM me if oyu want and I should be able to get you very good advice from my co workers in claims department if you wish.
    Also if they say there was a disclaimer sign say you didn't see it and that would help your arguement.

    The insurance companies always say that whenever you talk to them; claim you will switch ... can't hurt.

    also check your policy re NCB protection and if you were paying it.

    It's a disgrace BTW that a claim for theft / damage should affect your NCB. The only claim I've ever had was for broken window / cd player stolen and it did not affect my NCB. It was many years ago and I don't even remember who I was insured through

    shocking stuff.. the fact it was underground in a hotel makes it worse..

    they went out of their way (a) to find your car in particular and smash it up and (b) to provoke you further by getting the box of chocolates.

    it's not like you'd carry around a knife/blade on the street that could do that sort of damage, my guess is they arrived with tools in a car and left in a car.

    surely their is CCTV at the entrance/exit.. all you have to do is get a rough time frame of when it happened say 10hours, discount any cars with one person in them, email/ask all guests staying in the hotel that night what cars they had and by process of elimination narrow it down :confused:

    i doubt there'll be finger prints... not when there's broken glass/knives involved.. nobody would be stupid enough to go bare handed. all down to CCTV though...

    Thanks for the comments guys. Not getting the car fixed until the 8th Jan is one of the biggest pains. To be honest I am going to take legal action against the hotel/carpark once i get some legal advice

    Oh I'm sick for oyu. I've owned a soft top BMW for 6 years & it is always my worst fear. Was there many cars damaged in the same incident? you say the SL350 & another car where the chocolates came from.

    Oh I'm sick for oyu. I've owned a soft top BMW for 6 years & it is always my worst fear. Was there many cars damaged in the same incident? you say the SL350 & another car where the chocolates came from.

    Just the three cars damaged as far as I know. The SL was parked beside me.

    Frank Keane BMW dont do work on soft tops so they say. However Conlon BMW say they can fit it but no idea of labour charge.

    Sorry to see that happen to your car. I hope that you get it sorted.

    RE: responsibility, IIRC if you pay for the priviledge of parking, you should have some cover. Talk to a solicitor.

    RE: insurance, most companies do not his NCB in theft cases, even when the car is written off. Seeing as the chocolates were stolen from another car vandalised in the same incident, then there should technically be a case there for theft. If you use a broker, talk to them. Otherwise, after scrutinising your policy documents, perhaps you should talk to the ombudsman.

    I know that Jeremy, the guy who started Auto Electrical Concepts in Galway, replaced the roof on an e36 last year. Maybe you should try him.

    Id say most BMW garages would'nt have a clue how to install a soft top. It's not like they are doing 4 or 5 a week. I'd feel alot more comfortable going to someone who specialises in this. ( If such a company even exists in dreary old Ireland).

    I had a soft top fitted to a classic Mercedes last year by a guy called Gerry Killeen off the N11 past Bray. He charged me €400, and I found his work very good. Ph: 01 2860094.

    OP, This company installed my new roof, it was about 10 years ago and it was an XR3i but it might be worth a shout..

    Some of these guys have a policy that they only fit what they supply themselves but you've nothing to loose..

    Hard luck OP. They knew well what they were at. Scum of the earth(not the car of course:D).

    Surely to goodness the car park has CCTV?

    On a related issue, has the time come for cars to have their own digital CCTV system? Some cars have black box type devices in the US, surely desirable cars should be fitted with cameras of some sort that will work even when the car isn't on?

    And OP does the Z4 not have a volume sensing alarm? I would have thought the alarm should have gone off when the pajeros started attacking the car's roof?

    Was the reg number of your car on the hotel register ?

    If you were I think the hotel is responsible for the damage to your car.

    Thanks guys by the looks of this the hotel would be liable as I was staying overnight with them and also there were aware of the car as they took my keys when i arrived. What do you think would be the best way to go foward.

    The alarm would have gone off in the car alright but I am sure it would just reset itself after a while

    That's a real bummer, can't believe someone would do that.

    As for the insurance company, why would you not claim? You're insurance is hardly likely to go up by €3k over the next few years, or is it? I know you don't want to pay more, but that's what insurance is for. If you don't get any joy from the hotel, I'd put a claim in. I assume you've some sort of no claims protection, or step back protection, so that the increase shouldn't be too much.

    Why did they take the keys? Did they park it? Their possession of the keys would imply to me that it was in their possession/care at the time of the vandalism
