    ONE of the country's most experienced marksmen won a victory in the High Court on Tuesday last when his appeal against a garda refusal to license him to own a .375 hunting rifle, was settled in his favour.

    Frank Brophy, based in Curracloe, Wexford, has shot competitively and recreationally in Ireland and around Europe over the past 30 years.
    He also hunts extensively in Africa, including dangerous game, and he stated that the .375 rifle was for use in Africa.
    Previously in 2004, he had won another appeal against a garda decision to refuse to grant a firearms certificate for a target pistol. On foot of that decision he became the first Irish citizen in 32 years to be issued with a pistol licence. This action brought about the return of licensed pistols for sporting purposes.
    The 2004 judgment led to a large number of cases backed by the National Association of Regional Game Councils, forcing the government to amend firearms laws.
    New guidelines for the gardai on the issue of firearms certificates are currently being prepared by the Department of Justice.

    What is sad about this is that the Garda force people to go to court for gun certs that they can have under the law.

    This then means people have to spend there time and money fighting for there rights. It’s a waste of court time and a completed waste of tax payer’s money.

    The garda are not the law they are just the enforcers of it. There is enough crime in this country for the garda to stop wasting there resources on cases they know they have no right to fight.
