    I'm involved in starting up an online wine retail business and am trying to determine what the legalities are.

    Do I need a wine off licence and how is this obtained?

    I contacted the DETE and they pointed me towards the Department of Justice. They mailed me as follows:

    Under section 17(3) of the Intoxicating Liquor Act 2003, it is an offence
    for a licensee, with intent to evade the conditions of the licence, to take
    intoxicating liquor from the licensed premises for the purpose of its being
    sold on the account, or for the benefit or profit, of the licensee, or to
    permit any other person to do so.

    You will find further information in relation to the Licensing Acts in
    following books which should be available from a public library:

    Cassidy on the Licensing Acts (second edition) by Constance Cassidy (2001),

    Liquor Licensing Laws of Ireland (third edition) by James V Woods (2001).

    You should note that the Licensing Acts have been updated by the
    Intoxicating Liquor Acts 2003 and 2004 since these books were published.

    You may also wish to consult a solicitor if you wish to open a wine retail
    business as the Department is not in a position to provide legal advice.


    I was hoping for some information on costs and procedures but this legal jargon will have to do!

    A wine licence costs €280 a year but a full liquor costs an initial €170,000 for a premises.

    Customs and Excise have the forms for the wine licence. You'll need to be a registered business.
