So we don't have to deal with her, apparently.

The "Floodgates will open" argument on this thread has already been silenced.
The only precedent to this case in a common-law judicial system is the case of the 18 year old Somalian girl Zainab Fornah in the UK in 2006.
Since she was granted asylum for reasons of FGM over 2 years ago there has been 3 applications for asylum using fear of FGM in the UK. One accepted, one refused, one likely to be accepted on appeal.

Only a tiny minority of women in this situation will ever be in a position to claim asylum.

Due to the recession, a lot are leaving anyway.

Do you know what xenophobic means?
    pinder wrote: »

That's the stuff, anyone who views immigrants as actually having an effect on society is a PC do gooder, bleeding heart.
    pinder wrote: »

You're right. Irish people were just itching to work in McDonalds, stack shelves in Dunnes and clean streets.
The idea of immigrants taking all the good jobs is as old as the hills and frankly:
If an immigrant wants to do the job that none of the Irish people wanted to do during the Celtic tiger, fair play to them
If they are qualified enough to do a skilled job such as a doctor or engineer, excellent. We always need more of those.

How many unskilled jobs have you held? I've done a few and it's easier for an Irish person to get a job than an immigrant. Easier to understand, better grasp of English etc and more attractive to employers because of this.
THese were the reasons told to me by a manager on the sly of a shop I worked in Galway.

How about you check out our own history and see how problems such as this are more to do with poverty than some form of biological predisposition.
THe Irish in America were often viewed as being natural brawlers and muggers etc.
Once they started moving out of the poverty trap, such viewpoints changed dramatically.
    Wonder why.

Oh, I just love the "asylum seekers have put us in recession" argument. Terrific stuff.

Which country's web surfers are looking up the term "Immigration Ireland"?

    http://www.google.com/trends?q=Immigration+Ireland&ctab=0&geo=all&date=all&sort=0

Aside from searches originating in Ireland, searches from Nigeria(IBC Scam) and Pakistan(EU Treaty Rights Scam) dwarf the amount of searches from all other countries on the list.

Aside from Nigeria, Pakistan and India, nationals from all the other countries on the list do not require a visa to travel to Ireland.

Most people who are looking up the term "Immigration Ireland" in Ireland, look it up in Chinese. Very interesting. Most likely persons who let their "student" or "visit" permission lapse and stay in Ireland working illegally.

    http://www.google.com/trends?q=Immigration+Ireland&date=all&geo=irl&ctab=0&sort=0&sa=N

Irish people appear to be concerned with abuse of our asylum process:

    http://www.google.com/trends?q=refugee

    http://www.google.com/trends?q=asylum&ctab=0&geo=all&date=all&sort=0

    On a more humerous note:

    http://www.google.com/trends?q=porn&ctab=0&geo=all&date=all&sort=0

    We knew that already though:

And of course, the lisbon treaty:

The 9th of December - tomorrow.

The ECHR requested - does that mean that they don't have the authority to order? - that the family should not be deported until after midnight on the 10th. That sounds to me like they don't expect the case to go on for more than two days.

Does anybody know whether Ms Izevbekhai and her daughters have to appear before the ECHR in person, or whether their legal team will travel there, or whether the ECHR reviews documentation of the case so far, or how does it work?

It would be banal if most Irish people spoke Chinese, but they don't.

He has something in common with a large number of posters on here so.

But anyway, his opinion is somewhat irrelevant, so I'm not sure why you felt the need to link to this article and then point out that it counts for nothing? Was it mentioned earlier in the thread that Roddy Doyle is an authority on the asylum process?

Let's make an exception for Ms. Izevbekhai. Hell, let's make an exception for everyone seeking asylum.

Indeed, why stop there? If a mother is arrested for theft, let's just drop the charges. Why don't we simply decide that the rules don't apply if your children are suitably photogenic?

WON'T SOMEONE PLEASE THINK OF THE CHILDREN??!!
Irish people were just itching to work in McDonalds, stack shelves in Dunnes and clean streets.
Give it a few months and you might be right.

Let's make an exception for Ms. Izevbekhai. Hell, let's make an exception for everyone seeking asylum.

The Floodgates argument has already been refuted
The Fornah precedent in the UK in 2006 was followed by the levee breaking and a massive 3 applicants for asylum with FGM as the reason. 1 granted.

The question is not whether exception should be made to the rules. The question is are the rules correct or are they being applied correctly?

Was the reason for her claim failing the forward looking test because "Nigeria now has adequate protections against FGM?"

If so is this statement true? This article and many more like it seem to say that it is not true.
Are genuine cases from Nigeria (and elsewhere) being thrown out because it is easy for local authorities to point to empty "protocols" as a justifyable reasson to refuse asylum.

We all know the decisions that were made in this case the question is are they correct?

Have read it. Wasnt quite sure what you were getting at.
My answer applies to all of your post and your comments about rules.

Send her back to Nigeria and let the Nigerian authorities look after it. It's THEIR job to look after THEIR citizens. When our senior citizens can't even be looked after it's time to draw a line.

As has been said before, if every nation applied that sort of logic to every other nation, there would be no asylum seekers.

The ECHR has actually postponed a decision on the Izevbekhai case. From what my legal friends have told me, they (the ECHR) are not even sure it merits a hearing. Looks like Ms. Izevbekhai will be having her last Irish turkey this christmas.

    On what basis?

Not that I question you, but it isn't a small thing to have such a hearing so for such a dismissive attitude, I'd like to know the legal thought on it.

I assume it is somewhat more substantial and thought out than what we have covered here.

Or is it just "My friend Bill said...."
