Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

    Do Irish criminal courts have any jurisdiction over Irish citizens who commit crimes abroad ?

    Is the answer different if the victim is also Irish ?

    BTW I presume that the Criminal Law Jurisdiction Act 1976 relates solely to offences committed within the "British Isles" ?

    There is a common law presumption that criminal offences don't apply extra-territorialy, there are statutory exceptions to this.

    Criminal Law Jurisdiction Act 1976 gives the courts of the republic the power to punish certain offences committed in northern ireland.


    By virtue of the Offences Against the Person Act 1861 irish courts have the power to try an irish citizen for murder or manslaughter committed abroad.

    Under the treason act an irish citizen or permanent resident may be punished for treason committed abroad.

    Under the criminal justice drug trafficking act 1994 certain drug offences committed abroad may be punished in ireland

    Under the criminal law (sexual offences) act 1997 certain sexual offences if committed abroad by an irish citizen are punishable in ireland

    the genocide act and the geneva conventions act apply extraterritorialy to irish citizens.

    The piracy act applies to crimes committed on the high seas and may be punished in ireland.

    The air navigation act gives irish courts juridiction over offences committed on irish registered aircraft anywhere in the world or on any aircraft which lands in ireland. Similarly for ships the merchant shipping act.

    The Defence Act 1954 applies to members of the defence forces whereever they are in the world.
