If some one is VAT registered are they officially allowed to claim the VAT back on the diesel used in their family cars? i.e. when they are not being used for business Is this flouting the law? I consider this perk as discrimination against those that are not VAT registered such as the PAYE and smaller self employed sole trader.

It is flouting the law but you'd be blind not to see it going on. You have an account at the local station and fill any family cars there as well the jeep that runs on diesel.

And what's more, when petrol was cheaper than diesel (not so long ago) then the petrol cars would get marked down as diesel. So you were reclaiming on petrol and diesel even thought your work vehicle was diesel.

It's corrupt, meh everyone does it.

However, the same traders you are referring to would be extremly unlikely to ever use green diesal on a family car. Detection by customs will almost certainly lead to an audit by Revenue. Customs are people to be feared and respected

It's done so much that the revenue should automatically accept the practice and automatically reduce the rebate.

You can be sure that Revenue have the ability to compare diesel VAT reclaims with business profile, and with business and fleet size. Customs are part of Revenue.....

    Not your ornery onager

Vat on diesel also encouraging the ordinary non VAT registered citizens to flout the law and purchase vegitable oil in Tesco fir 99c Liter which would be not far off the price of Diesel less the VAT.

My brother said he would have no interest in running his van on Vegitable oil because there is no vat on it to begin with and would work out about the same as claiming it back on normal diesel.
