Simple solution to that one is never say where its gone, if they have a position they want to put you forward for get the company name and if your CV has gone there already then inform them of such. In other words they say the company name first then you say yes or no.

What I hate is the agencies that keep bumping positions to the top of every search list every day when the contract does not exist or is no longer open.
