Need Advice for My Friend

    My friend has been living in a flat alone for the past few months. And every now and again he would have friends over friday and sometimes saturday just having a few drinks, having a good time. Not been anyway out of order.
    On thursday, the owner told him he couldnt bring friends up anymore. He told hes friends no more friday and saturdays nights, and they said that was fine, but then today 2 friends called up and the owner followed them. And she told him today that he has to get out of the flat by tomoro morning.

    Can he do anything about this? :mad:

    Wow. What about his lease. What has he got in writing?

    It's unlikely that the landlord can impose such a term in the lease, so he can contact the PRTB or his solicitor.

    Another thing he can do is move to another apartment. Rents have been dropping, so it's likely that he will find another place for cheaper. He will probably also find a professional landlord as opposed to a crazy lady that hangs around her rental property imposing ridiculous rules.

    Best place to start looking for his rights.
    Even if he does not have a written contract he probably has some rights, like a months notice.

    The other thing that he should do in case he is forced out by the landlady is to write everything down that has happend recently - and exactly how it happend.

    would also advise contacting Threshold they are great- will give advice and if needs be will sometimes contact landlord for you.

    lease or no lease he hasnt done anything wrong and should legally be allowed notice equal to how often he pays rent ie if he pays monthly he is allowed one months notice.

    If he has paid a deposit and she has just decided to throw him out it may be an issue to get that back so tell him to contact threshold asap

    How did the owner know that your friend had guests over? And followed them? Does the owner live nearby?

    Has he lived there more than 6 months? If so, she will need to give him 4 years notice or something like that.

    She sounds like an awful ****. He should bring friends around every day. **** her.

    If the noise is becoming a problem in her building it could affect her other tenants or maybe they havealready complained to her. She should have outlined terms initially such as No Noise after 10pm etc. Not signing anything unfortunately gives you no rights..

    That is not true (you having no rights if you do not have a written agreement).

    The landlord cannot kick you out with a days notice (that went out with the famine!)

    Contact Threshold ASAP.

    His home is his castle, he is perfectly entitled to have visitors (having 100 people over for a party might be another matter).
    And she told him today that he has to get out of the flat by tomoro morning.
    His is entitled to proper notice, depending on how long he has been there. If she tries anything, it would be an illegal eviction and he is entitled to call the Garda.
