    Possibly on the wrong thread - apologies if so

    Brother of mine out for a pint on his tod in Swords atm and he's trying to hook up to the free Wi-Fi access in Eddie Rockets next door - would anyone out there know the password for this ?

    Criminal Damage Act, 1991

    "Theft of service" same as tapping into someone's Gas, Cable TV, Electric or phone.
    There are other criminal laws too.

    You can be also sued (Civil law) by Eddie Rocket's for Tresspass (Except in special situations you can't be prosecuted for Trespass).

    Many, many things can be criminal without a specific law, for example if there was no law on Mobiles while driving you could still be prosecuted for using a Mobile under "careless" or "dangerous" driving if observed by a reliable witness(es), i.e. Garda, that such use could lead to or did cause an accident.

    What if they had it unsecure and no password required but didn't give you actual permission would that be illegal too?

    Nope because if its insecure in a public place there is no limit on who can use it... would be there own fault

    You have to get into the vehicle, turn the keys, rev up a few times.. and drive off, would a defence not have a field day with the ambiguity with which Windows sometimes latches onto the first open access point?

    It is a machine, but with an OS behaving in mysterious ways, some times..

    Ah yes, Ireland the cuntry where the "ah sure that'll be covered under some ancient law" attitude prevails and if you ask the TDs to codify the laws they'll look at you as if you had two heads, "Sure wouldn't that be too much like work... :rolleyes:"

    Sorry but an unsecured network is open to use so expect it to get used if in a public place, if you want it not to be used then secure it, a trained monkey can do it if given the incentive (a banana or two) /rant ;)

    Its a bit late in the day now but there are plenty of eircom connections around there, easy to connect to.

    Yes Eddie's would be contributing to make it easy so any damages they might sue for would be reduced, or insurance may be affected.
    Makes no difference to criminality of use. The car analogy above is reasonable.

    Really guys, have any of you heard of a successful prosecution for this? I would hazard a guess that it will be no... Going too fast in your car is illegal too but you don't stop doing that either do you? It really is a moot point if it is illegal or not to use an unsecured network without permission, if the owner left it unsecured then they are hardly going to be aware of how to find out if their network has spongers on it and should really look for the local trained monkey to help them out!!!

    If you don;t have permission to access the network then you shouldn't be accessing it unless its advertised that you can, the network in question appears to have security and I don't want to see any discussion on how to get around this.

    If the OP wants access then he/she should contact Eddie Rockets for more info, anyone this thread is of no value...locked
