issue with 6300 and micro sd card

i bought a card on ebay he said it is 100%compatable with my nokia 6300 Item number: 120297451180 dosent pick up the card. seller says its mabe a firmware problem should of told me this may be an issue before the sale. its not that old 07 dec firmware. what are my rights here?

Under distant selling regulation I think you've 7 days to return the goods....did you try and use it in another phone just to make sure it's the card and not the phone...

tried in samsung u600 wouldnt work,
