Where do I stand ????

    Hi,

    My wife and I have decided we have both had enough of each other. We dont love each other anymore and are only hurting each other by being together.

    I'm in full time employment and have a healthy wage €700 p/w, while my wife works as a carer for her mother who is very ill and only earns about €150 p/w. We also take in students for additional income and she gets all of this about €700 per month but this is only seasonal/term income.

    I have always paid the mortgage and all household bills for the past 10 years or so. We have two beautiful kids but one is from another relationship that she was in before we got married. Both of us have applied for mediation and are currently on a waiting list.

    My question is this. Am I screwed and what is the most likely outcome?

    Any help or advice would be very much welcomed.

    I empathise with you, it is a very difficult and traumatic experience coming to the realisations that you have. And you should consider seeking out any support or specialist help available, such as mediation, support groups, counselling, etc.

    Very, very few people walk away from divore/seperation proceedings and feel that they have won or done very well, so in that sense I don't think anybody is likely to 'win' financially. And I say this because essentially the same money will now have to fund two households instead of one. It is nigh on impossible to tell you how the financial aspects of the breakup will play out. If it ends up in Court, the Court's overriding duty is to ensure that dependents and the spouses are adequately provided for. What that means in practical terms to your case is impossible to say, to have any idea whatsoever you would need to be further down the road in your proceedings.

    Mediation is an excellent first step, but I would be loathe to enter any enforceable agreement without consulting with your own independent legal advisor. It may seem that you are saving money by not getting one involved, but it could end up costing you a lot more in the long run if you don't.

    How can anyone here tell you what the outcome will be? It depends on all circumstances and there are no set rules as to who gets what.

    Talk to a solicitor if you want advice.
