Donegal Coucil; planning breaches

    Good morning.

    We are wondering if what we are enduring is the norm here.

    In a rural area, of great beauty, which is agricultural with few houses, we checked when we moved that there would be relative peace.

    We learned that a man nearby who is said to be a millionaire, had been refused planning permission for a filling station, so we thought we were safe from development and of course we checked the online planning site to be sure.

    A house and a double garage were all; and these were almost completed.

    That was 18 months ago and since then the construction and other work has not stopped. There is now a large "hangar" a row of truck containers, <SNIP>, and he is still working with digger and with lorry loads of hard core.

    Vans come and go, and a loud outdoor phone echoes.

    Piles of pallets complete a bleak scene. Complete with fork lift truck.

    He owns two diggers there by the way.

    Surely this classes as light industry; he also has vans and cars on show for sale there etc..

    We learned from a Council worker that the lorry loads of hard core are waste - from a Council building site no less, who apparently have nowhere else to dump the stuff.

    The climax came when private helicopters started landing there; stampeding our sheep..the place is right on a main road..

    We complained/ reported this all to the Council Planning and Environment dept; many months ago.

    Nothing has been done and when work started again y'day we spoke to them on the 'phone. All they will say is that the matter is being investigated.

    That the file is with "our enforcement officer"

    We really do not want the hassle of relocating.

    But we are at a loss over this. Surely there is legislation to deal with these clear breaches?

    There is legislation to deal with unauthorised development. The matter is with the Council's enforcement officer who may refer it to their solicitors. This thread and topic is going down the legal road and we cant allow discussion here on a matter that possibly could end up in the courts.

    If you feel you are not getting a proper response from the council or that the problem is not being investigated properly then you should discuss it with your solicitor.
