Nokia N73 Problem

Hey, having a bit of trouble with a Nokia N73 I bought in February.. About 5 or 6 times a day, possibly more I take my phone out of my pocket and it's switched off - without the battery being dead I might add. Is this a problem with the phone or battery? Any help would be great, thanks.

my N73 sometimes knocks of when it gets a bad bang, using a piece of paper between the phone and battery to make it more secure seems to have fixed it.
