    Two Sale and one Toulouse player are due to appear before independent Disciplinary Committees in Dublin on Thursday, 16 October as a result of citings arising from their Round 1 matches in the Heineken Cup.
    Rudi Keil, the Sale Sharks replacement (No 22), was cited in the Round 1 Heineken Cup Pool 1 match against ASM Clermont Auvergne at Parc des Sports Marcel Michelin on Saturday, 11 October, 2008.

    The citing lodged by the Citing Commissioner for the match, Achille Reali (Italy), is for an alleged dangerous tackle / striking / playing an opponent without the ball of ASM Clermont Auvergne centre Benoit Baby (No 13) in contravention of Law 10.4 (a), 10.4 (e) and 10.4 (f).

    The independent Disciplinary Committee will chaired by Mark McParland (Ireland) and also consist of Rob Flockhart (Scotland) and Simon Thomas (Wales).

    Law 10.4 (a) - Punching or striking: A player must not strike an opponent with the fist or arm, including the elbow, shoulder, head or knee(s).
    Law 10.4 (e) - Dangerous tackle: A player must not tackle an opponent early, late or dangerously.
    Law 10.4 (f) - Playing an opponent without the ball. Except in a scrum, ruck or maul, a player must not hold, or push, or charge into, or obstruct an opponent not carrying the ball.

    Kris Ormsby, the Sale Sharks lock (No 5), was cited in the Round 1 Heineken Cup Pool 1 match against ASM Clermont Auvergne at Parc des Sports Marcel Michelin on Saturday, 11 October, 2008.

    The citing lodged by the Citing Commissioner for the match, Achille Reali (Italy), is for the alleged punching / dangerous charge of ASM Clermont Auvergne lock Julien Pierre (No 4) in contravention of Law 10.4 (a) and 10.4 (g).

    The independent Disciplinary Committee will chaired by Mark McParland (Ireland) and also consist of Rob Flockhart (Scotland) and Simon Thomas (Wales).

    Law 10.4 (a) - Punching or striking: A player must not strike an opponent with the fist or arm, including the elbow, shoulder, head or knee(s).

    Law 10.4 (g) - Dangerous charging. A player must not charge or knock down an opponent carrying the ball without trying to grasp that player.

    Byron Kelleher, the Toulouse scrum half (No 9), is due to appear before an independent Disciplinary Committee in Dublin on Thursday, 16 October as a result of a citing arising from the Round 1 Heineken Cup Pool 5 match against Bath Rugby at Le Stadium, Toulouse, on Sunday, 12 October, 2008.

    The citing lodged by the Citing Commissioner for the match, Ray Wilton (Wales), is for the alleged stamping of Bath Rugby outside half Butch James (No 10) in contravention of Law 10.4 (b).

    The independent Disciplinary Committee will be chaired by Simon Thomas (Wales) and also consist of Mark McParland (Ireland) and Robert Williams (Wales)

    Law 10.4 (b) - Stamping or trampling: A player must not stamp or trample on an opponent.

    NOTES
    (i) Citing Commissioner
    a) Citing Commissioners will be appointed by ERC for all Heineken Cup and all televised European Challenge Cup matches and shall be entitled to cite a Player for any act or acts of Foul Play that in the Citing Commissioner's opinion warranted a citing.
    b) For such matches Clubs will not have the power to cite a player but may refer incidents to the Citing Commissioner within 24 hours of the conclusion of the match.
    c) The Citing Commissioner will have 50 hours from the start of the game to make a citing and the determination of the Citing Commissioner will be final and binding. In exceptional circumstances this deadline can be extended.
    d) Should the Citing Commissioner decide there is a case to answer he will notify the Disciplinary Officer and the Disciplinary Officer will then bring a charge against the cited player.
    e) This case will then proceed to a disciplinary hearing.

    (ii) Independent Disciplinary Committee
    a) Citings will be heard by an independent Disciplinary Committee as soon as is practicable. Until the hearing a cited player is eligible to play in ERC tournaments
    b) The independent Disciplinary Committee is chosen by the Chairman of the independent Disciplinary Panel, Professor Lorne Crerar.
    c) The ERC Disciplinary Officer, Roger O'Connor, presents the case against the player
    d) Both parties to the hearing (ERC and the player) have the right to appeal decisions of the independent Disciplinary Committee. Appeals must be lodged within 72 hours of receiving the full written decision from the Chairman of the independent Disciplinary Committee
    e) The full written decision of the independent Disciplinary Committee will be available on www.ercrugby.com/discipline when the disciplinary process is complete
