PAYE tax credit for spouse of a properitary director

    Quick question, is the spouse of a properietary director of the company by which he/she is employed entitled to the PAYE tax credit?

    if you don't pay PAYE you don't get the credit. period.

    Yeah, but the spouse is paying PAYE, deducted at source by the employer. According to the Revenue briefing linked the spouse is still not entitled to the PAYE tax credit, or am I missing something?

    The person paying PAYE is an employee of the company of which the spouse is a proprietary director. My reading of the link is that the spouse is not entitled to the PAYE tax credit.

    She's a connected person to the company in question and as such, unfortunately is not entitled to the credit. It's a quirky one alright, but that's just the way it is.

    The spouse is working for the company as spouse of a proprietary director....he/she is therefore regarded as Class S and is not entitled to the PAYE credit in this employment.

    The meaning of Proprietary Director for Tax and Social Welfare purposes are different.

    As such, just because a person is a Proprietary director of income tax purposes, does not mean they are subject to Class S PRSI. To get Class S, you must not be employed under a contract of employment.
