Sound Proofing Advice Needed

    We live in a apartment which we bought from DCC four and a half years ago but we now have our mortgage with a private bank.We can hear nearly everything from the apartment above us till all hours of the morning and we have had enough,we have talked to the girl upstairs but nothing has changed.We have got in touch with two sound proofing companies.The first company we contacted told us they also do sound tests at a cost of seven hundred euro which will determine were building regulations broke in relation to the insulation of our ceiling.If there was this company told us through their solicitor the builder would be forced to pay for any sound proofing done.The second sound proofing company told us its a waste of time doing sounds tests because its nearly impossible to get the builder to rectify anything even though they might have broken building regulations.The Department of Environment referred us to the Building Control Officer in DCC but he is impossible to contact.PLEASE HELP

    First of all Im not sure what you are actually looking for here. I should point out that there will be no discussions in relation to the legalities of the situation you find yourself in.

    If its a recommendation for a firm that will conduct a sound test for you then personally I dont know of any but if someone else does perhaps they could PM you the details.

    If you are looking for advice as to who was responsible for or who should remedy the problem then we cant really advise you as that is a legal situation.

    My advice is make a written submission to the building control officer. Forget about phoning him or calling into the office. I would also point out that if you bought the apartment of a local authority then Id be reasonably sure that you bought it "as is". Whatever condition it was in prior to you buying would be what you paid for and they (council) would not be responsible for any improvement works. You should have a copy of the contract of sale so have a read through it.

    Finally are you telling us that you have a problem with noise only since (a) you bought it from the LA or (b) since you took out another mortgage or (c) since a new tenant moved in above you.

    We hve had the problem ever since we moved in but its geting worse and worse as time goes by.Really what Im asking is there any one on this forum who has got a sound test done which found building regulaions were broken by the builder so were forced to fix the problem.

    But you didnt buy the apartment from the builder. As I said you should really read the contract of sale or get your solicitor to have a look at it and advise.

    Perhaps someone else has been in a similar situation so lets wait and see.
