Same sex marriage

    Living in the US for a year they have an election on tomorrow (as if you didn't know) - in California people are being asked to vote on proposition 8, an amendment which would overturn the Supreme Court decision to overturn legislation defining marriage as between a man and a woman only.

    In Ireland due to the wording of our constitution I don't think same sex marriage is something that will be adopted without constitutional amendment (civil partnerships are a completely different case).

    But what are people's legal feelings on this - yay or nay? And would our constitution (or indeed should?) allow same sex marriage?

    And from talking to a few young law students (so really on secular arguments alone), it's surprising how many are against marriage (but most seem pro-civil partnerships).

    On a personal level, I don't have strong feelings one way or the other. It's about as relevant or emotive to me as say what colour tie An Taoiseach, Brian Cowen happens to be wearing on any particular day! But putting my lawyer hat on for a moment and being entirely pragmatic, I'd have to say that I'm all for it! In these times when work is becoming scarcer, why not allow same sex couples get married, as invariably and a little down the road it will lead to a new, heretofore untapped resource of potential family law cases.. ££££
