Do landlords keep deposit, if you break lease?

    Hi,

    as some of you may know, we successfully got a landlord down to €1000pm from €1100pm for an apartment (not moved in or signed anything yet). But the contract states the deposit (€1000) will be forfeit if we leave before a year. The thing is we will definitely be staying a minimum of 6 months, but might have plans for travel/etc in October.

    So we are going to ask the landlord for a 6 month contract instead. But just wondering is this normal practice to keep the deposit, even if we give a months notice before moving out.

    Deposit is often kept if you break the lease. If you talk to the landlord and say straight up that you plan to leave before the 12 months, he may say differrently.

    I'm afraid you would lose it unless you got someone suitable in for remainder of the lease and that would have to suit the landlord.

    Hi Ya, About 4 years ago me and bf lived in an apt in Dundrum. We left 3 months before lease was up. Our deposit was 1200 and he kept 300 on us. He said he was entitiled to keep it all but because we left the place immaculate and someone could move in straight away he only kept that much. we didnt argue, we were just delighted he didnt keep it all. :)

    Thats clause in the contract is not legal. As you are able to terminate your contract any anytime (and get your deposit back) by give the correct written notice or getting someone to take up your tenancy (if the landlord agrees).
