Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

Snagging not done and final bill

    Any thoughts on the following later complicated situation.

    We were following the standard RIAI architect and builder contracts.

    We fell out with our architect during the last phase (it's a long story).

    Now it has come to the end of the defects liability period (one year in our case). In the contract with the builder it says that the snagging should have been completed by the end of that period. Now the builder has shown no interest in completing the snagging other than coming around and telling us he will do it but nothing has been done.

    Where do we stand? We would like to tell the builder his time is up and go and get someone else to tender to complete his snagging. There is 5% owed to the builder if he were to complete the snagging.

    Any ideas on this situation?

    Notify the builder in writing that if he is not going to carry out the snagging, within a reasonable timeframe (say 2 weeks), that you will get the snagging carried out by others at a reasonable cost.

    Get another builder or some sort of handyman to quote for the snagging and if the original builder still is not willing to carry out snagging, go with new builder. If the new builders costs are less than the retention witheld on the original builder, offer the original builder the balance or the money.

    That's basically the way it should be done.

    Make sure you have a paper trail (includuing reasonable quotes from new builder) in case the original builder gets stroppy!

    I too agree that the paper trail is very important.

    It would also be a good idea to have an Engineer or Architect (suitably qualified)inspect work and confirm the snags outstanding. It is highly likley that they will note other issues.

    Depending on the size of the property this should cost between €300 and €400. Money well spent.
