copyright on music for video

    i want to make a video to put up on youtube, and would like to use a classical piece as a backing track. seeing how it's really old, can i assume that the copyright is out of date and i'm free to use it?

    is there a problem using a recording of a classical piece that has only been recorded recently by someone else, but the song itself is very old?

    all help appreciated...

    (IANAL) Both the piece itself and the individual recordings both hold their own copyright, IIRC so while there would be no problem with you using an original recording using a recent one that is not in the public domain or otherwise permissively licensed could cause problems.

    what about other YouTube videos?
    i presume they are copywrited and i can't use them as backing tracks?

    No other youtube video fall under common copyright agreement that all users signed. meaning you can use the videos of other youtube users in your own youtube videos.

    Though this has been contested as some users tend to file DMCA complaints against anyone who uses their footage.

    But so far all these DMCA claims have been proven false
