Reduce site boundary before building.

    quick one.

    I agreed to buy a site (subject to planning)

    I have since received my planning, and will now buy the site. I have noticed on the site layout maps submitted to the council that it takes in a bit of land that I did not want.
    The house is not built and the site itself is not in my name yet. The seller is willing to take this piece of the land out of the deal.

    Can I/how could I get the site reduced by the solicitor prior to submitting it to the Land Reg office. Is this possible?

    To answer your question, technically yes it is possible but I wouldn't advise it or your solicitor will not let you do it as you will not have planning permission on the new site. Planning permission exists only on the site you applied for it on (the red line on the maps and layouts attached to the application).

    hmmmm. ok, many thanks, I should have also added the fact that its just land at the back of the house and doesn't obviously include any buildings or walls which I have applied for.

    I will keep you posted . . . If cant reduce it, good and well.

    You can reduce the site but you will have to reapply for planning permission on the revised site boundary and if you have started you will have to apply to retain and complete. If you can afford the time (3 months) and you havn't started reapply with the revised boundary, as long as it dons't reduce the site below the minumum required by the Co Development plan it should be a formality (well it is in Mayo anyway!!) The simpilest thing howerver is to leave it as it is.
