I am thinking of giving up my county council house in the next year or so . I was wondering if my daughter could take over paying the rent. My wife and I split up and she had to leave me the house and go in to private rented accomdation. My daughter lives with her mum and She is only 17 but sould be 18 by the time i leave. They had to give up their rights to this house. Is there anyway now they could get the house back if i leave??

It is my understanding that she must have been continuously habitually resident in the property- in order to take over the lease- and would be accessed on her own merits (i.e. if it is a family dwelling, and she is a single person- she would not have an automatic right to rent the property at a reduced rate). A possible course of action might be the tenant purchase scheme- whereby a tenant could legitimately purchase a property at up to 30% discount on the OMSP of the property (I've attached a brief summary- that I found on Cork County Councils website).
