It may be helpful to know that the Data Protection Commissioner prosecuted Zamano in the Dublin District Court in respect of numerous complaints about unsolicited marketing messages received in 2007. After a Judicial review by the High Court in relation to a similar but unrelated case, Zamano recently pleaded guilty and made some refunds to users where the Data Protection Commissioner established that "there was no validity in relation to the opt-ins claimed". It is said that as a result Zamano has "considerably improved its procedures in relation to verifying opt-ins claimed by the clients who use its technical infrastructure to send marketing text messages".

This would seem to vindicate those users who felt that they had never asked for these expensive and pointless text messages, accidentally or otherwise.
