    Hi,

    I am currently investigating an AIB Ark Life Life Insurance Policy that my late mother took out in 1994. The thing is that I think Ark Life have been taken over by Hibernian Aviva. Thus, I am not 100% who to contact.

    I have contacted AIB (there seems to be no website / information on the AIB website for AIB Ark Life) and I am still awaiting a response.

    I need to get a copy of the original proposal form that was filled out in 1994 and the Ark Life are disputing the claim.

    Does anyone know if the Insurance company is legally obliged to send me a copy of this document. I need it as I need to decide if there is a case as Ark Life are not willing to pay out due to a medical reason.

    Any advice would be appreciated.

    I presume that you have already made contact with them as they have made a decision on the claim. ARK Life's head office is Hatch Street off Harcourt Street. Back in 1994 they was no onus on an insurance company to provide a copy a completed proposal form. I think that came in around 2000. However if they are disputing the claim, they usually would disclose the reasons for turning the claim albeit perhaps via the GP, if you could get them on side. You should try calling the claims department and try a softly softly approach where if you are say the executor of the will you will be entitled to engage with them. If they are going to turn down the claim if could be because of not disclosing a certain medical condition that may or may not have been present at the time of signing the proposal form. This is key and that is why you want a copy of the proposal form. By taking the view that you wouldn't expect a payout if there was non disclosure but the only way that you can see this is by getting a copy of the proposal form. If successful with this you should be able to, with the assistance of the GP be able to ascertain whether it was a material fact or not at the time. Only after going down the route yourself or GP would I consider the legal route. As she is not here to give her side of the events, it boils down to the proposal form and any available medical evidence.

    They never pay out. They are rich kids working in a job designed to extract money from the working class. I am a anti-socialist but I am also anti-cronism-spoiled rich kid club.

    I suggest you see if there is a group that can help and record this matter at least. The abuse they are responsible for is similar to the cathloic church in the 50's.
