Housing Miscellaneous Provisions Bill 2008 was passed by Dáil Éireann last night

    I'm sure many on here will find many things in it useful.

    The Bill makes provisions for Incremental Purchase of flats amongst other stuff, there's changes to the PRTB, Housing Action Plans for Local Authorities, allows folks who have Affordable Housing to re-mortgage and loads of other stuff.

    Does anyone know how long it will be before these changes actually take effect? I'm waiting to remortgage so am trying to get a bit of info on it..Thanks

    That's progress.

    Now we just need them to pass the Multi-Unit Developments Bill 2009.

    A very quick skim of this shows that some of the things I thought were going into the Multi-Unit Developments Bill 2009 seem to be in there
    (example being section 68 (on page 77 of the PDF) which deals with setting up and minimum contributions to a sinking fund)

    Also, Management company / Apartment owner disputes no longer fall under the remit of the PRTB:
    Part 7 wrote:
    (2) Section 3 of the Act of 2004 is amended—
    (a) in subsection (2)(c)(ii), by substituting “a household within
    the meaning of the Housing (Miscellaneous Provisions)
    Act 2009 assessed under section 20 of that Act as being
    qualified for social housing support” for “a person
    15 referred to in section 9(2) of the Housing Act 1988”, and
    (b) by inserting the following subsection:
    “(3) Notwithstanding the definition of “tenancy” in
    section 5(1), in this section a reference to a tenancy does
    not include a tenancy the term of which is more than 35
    20 years.”.

    Oh, i like this piece too:
    (5) The Act of 2004 is amended by inserting the following section
    after section 147:
    147A.—The Board shall, at such intervals as are

    specified by the Revenue Commissioners, disclose
    to the Revenue Commissioners information con-
    tained in the register the disclosure of which to the
    Revenue Commissioners is reasonably necessary 25
    for the performance by the Revenue Commis-
    sioners of their functions.”.

    And thus the clampdown on non-compliant landlords begins...

    Quite a few in the same boat mate.

    The Bill was signed into law by the President the other day but the only section that comes into immediate effect is section 100 I think.

    You'll have to wait a while to be able to remortgage but the hard bit is done... the law is there to enable it, the relevant section of the Bill will be enacted when the appropriate regs are drawn up.
