    So why are these Americans in this country? Toss em in Jail and deport them tomorrow.

    I don't think the article has the full story but something to bear in mind is that a couple of guys who work in construction, and regularly visit the US might make INS suspicious - particularly if they regularly visit for months at a time (though I don't know how long they did visit for).
