3e TV3 look for changes to the licence arrangement

    As you have seen over the last 7 months TV3 has significantly reduced the low standards of Channel 6.

    Anyone know what the changes are they are looking for?

    Yes, they want to be the Herald AM while RTE becomes the Metro.

    In the meantime they pocket the licence fee.

    The Commission also approved a proposal from TV3 that the licensing status of the 3e service be amended. The service will now be licensed under Section 34, rather than Sections 36 and 41, of the Broadcasting Act 2001. 3e will no longer have a separate contract with the Commission but will be covered by the main terms and conditions of the existing TV3 contract.

    I don't see how this helps them with their Sky EPG Position????

    It doesn't.

    Section 34 (now repealed, but still operative pending the SI establishing the BAI).

    "34.—(1) Subject to subsection (3), the television programme service contractor may provide, in addition to any free-to-air service being provided by it immediately before the commencement of this section, such other broadcasting services (whether free-to-air or not) as it considers appropriate, including broadcasting services of a community, local or regional character.
    (2) The television programme service contractor may, for the purposes of providing a broadcasting service under subsection (1), enter into arrangements with a holder of a digital content contract whereby that holder provides a compilation of programme material to the contractor for that service.
    (3) The television programme service contractor shall not provide any broadcasting service referred to in subsection (1) unless the Commission has authorised the provision by the contractor of that service by means of a variation made by it, at the request of the contractor, of the terms and conditions of the television programme service contract (which variation the Commission is hereby authorised to make) and the provision of the service shall be subject to the terms and conditions of that contract as so varied and subsections (1) to (3) of section 18 of the Act of 1988."

    Basically its just a tidying up by TV3 of their contracts. 3e will now be provided under the main TV3 contract rather than under a seperate contract.

    Which leads us back to the question why TV3 bought Channel 6?

    As point out before TV3 could have run other services long before Channel 6 under the act and section 34.

    Because by buying Channel 6, they got all their programming rights instead of having to go out and buy rights on an individual basis. Oh, and they got a carriage agreement and extra EPG slot on both Chorus NTL and Sky without having to go out and negotiate it (an especially problematic thing on Sky these days).
