itouch - comes with os3?

Hi bought an itouch 16gb in argos on Saturday. It's 2.x os in it... think I could have gotten one with 3.0 somewhere else? Would apple entertain sending an upgrade? (no idea how to mail them.) Or stop being tight and shell out €7.99 for the new os...? Any input appreciated. Cheers

pretty unfair to offer it for free to Iphone users and not us itouch owners!

Just get it for free though, much easier..
