Vendor refuse to supply certificate of compliance

    Hi,
    I hope someone can advise. I am purchasing a house in dublin, but the vendor refuses to supply a certificate of compliance for the house. The house was built in the 50's but it has been renovated and an extension added. For me to get this done will cost approx 3k. what should i do??? thanks...

    Talk to your solicitor who will most likely advise you not to buy without a cert. Your solicitor should also be in touch with the sellers solicitor and I hope they can get it sorted.

    This is essentially a legal query and we dont allow discussion on legal matters here but I'll leave it open for a wee while to see if others want to post a comment but I dont want to see a whole legal debate going on here.

    How long has it been since it was renovated and extended. There is no requirement for the seller in this situation to provide one AFAIK.

    The onus is on you to get your own surveyor who will advise you on the condition of the building and any potential problems.

    However this said these are powerful times for any potential purchaser and you might be able to convince them to provide you with one.

    I would still get a good surveyor to do a condition survey as a minimum and would have more faith in what they say than anything i receive from a seller.

    The legal department of your lender will take a view on this . During the boom many sales like this proceeded on the basis of the the vendor "declaring" that certs would not be furnished - and sales proceeded on that basis .

    Why ? Because prices kept rising . If a purchaser defaulted , his lender would easily recover the loan value after re possession . Different story today .

    Non legal advice - it should be plainly obvious - don't spend money on certifying someone else's property . There are many more to choose from now .
