Old place of employment treating me really badly.

    I worked in a well known clothes shop in temple bar.

    They let me go, claiming that they hadn't enough money to keep me on, the next day I saw on their facebook that they were looking for a whole load of new staff including a new part-time sales assistant.

    I was sacked in the middle of my working day and they expected me to finish the day but I broke down crying.
    I was supposed to work the following Saturday and when I went in to check my shift time I was escorted out by the security gaurd and told I was no longer allowed to shop there
    They never gave me my 1 weeks written notice, I was shown a payslip but had it taken back off me. I wasn't emergeny taxed despite it being my first job, I was also supposed to recieve 635E in wages and only recieved E245

    Now they will not give me my p45, payslips or pay me for the days worked after the last payday.
    I have sent them 6 emails which I have record of and endess phonecalls, I have been hung up on every time and even once heard the staff going "**** its XXXX* and hanging up.
    I ended up having to resort to contacting them on Facebook, they replied telling me to ring the store, I said " I seem to be disconnected every time" they proceeded from blocking me from the Facebook so I couldn't contact them anymore.


    I was later told by a friend that works there that I was sacked because the staff didn't like me. I did get bullied pretty badly and theyignored me If I saw them outside work. They all also blamed all their mistakes on me.

    I don't know what to do please help :(:(

    Definitely sounds like something dodgy has happened here.

    Depending on how long you were working there, I would say it's unlikely that you will be able to get anything through unfair dismissal. They probaly have a long probatation built into the contract that allows them to let you go as they please. However they can't withhold your P45 or monies you are owed. However I am not sure what the legalites would be towards proving that you are owed money. It could end up with a your word against theirs.

    Hey.. to answer both replys above...
    I was working there 2 months and had a probationary period of 3.
    I 've realised there is nothing I can do about losing my job I just want my money and the things which I was promised under my contract.:(
    They really are taking the mickey now

    I had a look at this link and although redundency is a valid reason for dismissal
    I was chosen despite another part-time sales ass. being hired the day after me :( They gave me no reason as to why i was the only member of staff selected for this so called redundency, I asked for a notice of one week, as stated in contract with my exact reason for dismissal. My OH recieved this after he was let go from his place of work.
    Ah I'm so angry. There is a citizens advice board near my college, might pop in later

    You have no right to go to the emloyment appeals tribunal onless you are working there a year onless you think you have been sacked because you are pregnant or tried to join a trade union... this would be to take legal action & looking for compesation for being sacked...

    Regarding your money you are entitled to every penny so I would get onto someone about that... I don't know who but I would check online..

    I take it you didn't give them a P45 since its your first job?.. Did you go to the tax office & fill out the form for sorting out your tax?

    If you haven't & the emergency tax just stopped for no reason then there could be an underlying reason for you not gettin emergency tax.. they could be fiddling the tax man so I'd give the revenue a call...

    If they have paid you then you are entitled to a P45... I'd ring the revenue on this too...

    Or even better ring Jerry Ryan or Spin & name & shame them...

    What was the shop call?.. Was it a certain jean shop in the Jervis?

    I asked would I need to fill out the P46 form which as I understood was needed to begin paying tax(they treated me like I had no idea what i was talking about when i said this)
    They said they had sorted out everything for me(should have checked myslf I know but it was my 1st job)
    What also concerns me is that I never gave them my NI/PPS number????

    This would almost make me think that they're bringing people in and letting them go before the probation period. Could be a tax/training/benefits scam?
    Maybe I'm being too cynical.

    As far as a reason and any recourse, I'm fairly certain that you don't have any. Most probation periods are set-up so they don't really have to give any notice or reason. A decent place won't behave like this but this doesn't sound like a decent place.

    Pop in the Citizens Advice place and see what they say. They'll give you the best advice. Getting in touch with the revenue would probably be a good idea.

    @chachabinx - I'd doubt it's a good idea to name the shop at this stage.

    Ok ring the revenue ASAP that is definately fishey... and you got charged emergency tax already... there is something going on their it is impossible to pay someone without your PPS number nevermind tax them...
    It is a legal requirement...

    MAKE SURE YA DO NOW COS THEY CAN'T GET AWAY WITH TREATING YOU LIKE THAT!!

    This is karma on their part...

    Go onto the cizizen info bureau website or even give them a call they are really helpful & ask who to get onto about pay

    Write a letter to the inspector of taxes paye section. Details is what will get this noticed. So spell out in clear unbias way the facts and the exact wages you received and what was deducted. Revenue are not responsible for employers issues so no point mentioning these.

    End of the day you just want what your due so I recommend you put a cc at the end of your letter showing this was sent to the employer and then send an exact copy to the shops head office not the actual shop. No one in there right mind will ingore such a letter. Try to get a contact in revenue to send the letter and follow up. They will investigate.

    that'll get you nowhere, you need to protest outside their shop - if they see someone with a placard it'll scare them, and it'll drive customers away. what have u got to lose?

    dunno if that's legal though :)

    OP did you get anything in writing to say you were being made redundant? If so, then you can take them to a tribunal, or to the small claims court if you just want to get back the money you are owed.

    It's pretty obvious what shop this is - I mean there's only one large and well know clothes shop in Temple Bar, and they're not exactly known for being ethical - they steal t-shirt designs off small designers who they know won't have the money to sue them. They've been doing it for years. So i'm unsurprised to hear they treat their staff like crap.

    well they are absolutely no help because the shop never ****ing registered me for tax

    That's not your problem.

    The employer owes employers PRSI on your employment, so get in touch with the Tax office and give them details of all the hours you worked and any tax you paid.

    If you are a student you will prob be getting the tax you paid so make sure you get it all sorted with the tax office before the end of the year.

    In future, when you start a new job, get the employers tax number and your psq no and call the tax office to tell them of your new job.

    Did you get a P45 in the end? if not make sure the tax office know about this.

    Nope Nothing.God i'm so angry. I think the tax office have sent them a letter but nothing as of yet. Man am I going to take these bastards down

    They finally paid me, got a bank statement today.


    Now all I have to do is get myP45 and sort out my tax

    If this was me, I'd do everything I could to make an example of them. They are obviously flouting as many laws as they can with apparent ease.

    Also, confirm with the tax office that the company in question have paid your tax after they put you on emergency tax. If not, you may find the revenue chasing you down in a few months. [speaking from experience, and cost me £2000]

    Ensure that said company forwards on your P45. By law, they have to. Of course you can get these details from the revenue but why make it easy on this company. TELL THEM that you want a P45. Threaten legal action.
    * Go into the shop
    * Be firm but don't get loud or angry
    * If their security touches you and tries to eject you, threaten to call the police. Legally, if they touch you they assaulted you and can be done for it.
    * Insist to whoever is in charge, that you want your P45 or you will take matters further [as you have already proven by getting the tax office onto them.]

    Jeebus, this makes my nutz boil, the way some companies think they can treat people.

    :pac:hope you dont let them away with this as they will do it again to someone else. As soon as you get your self another job and settle down contact a solicitor, free legal aid and go for unfair dismissal. You should get some money out of it even if it takes a while. Employers have a duty of care of staff. They failed.:pac: they should be eaten alive.
