Hiya I am having a bit of a problem...
I get paid monthly but haven't been paid for three months. I've been lied to and told "next week, next thursday next friday". I am the last one at this stage to get paid in the office (the other lads are 2 months behind) so I feel I am being singled ot because I am replaceable as I work in admin and all the other lads are more specialised. I offered them a payment plan to clear the back log, got a cheque and it bounced and no money this week. I have decided I have to leave so I told him I wouldn't be back until the issue is resolved. He is ridiculous with paying and if I leave I'm not going to get paid for a good while. I am going to the solicitor to get a letter written to him, I basically have been forced out of my job, its like constructive dismissal. I will also be going to the employment appeals tribunal. Basically if anyone has been in this situation or has any advice it would greatly be appreciated.

I'll probably get given out to for suggesting this, but before you leave make sure your email is password, any documents/work you were working on are all encrypted or otherwise inaccessable.
If you don't work on PCs, then make sure there is something else there that only you do or have access to and make it inaccessable without your physical presence.
Tell your employer you are unable to come to work as you can't pay for transport and you aren't coming back until you are payed.
If he needs whatever you have access to he will pay all your arrears.
You then come back hand over whatever it was you had and leave again.

    Hi there

Tell you the my story, I was not paid for one month so I got out of the job pretty dam quick,. I did go legal and won my case plus expenses but to date have not and more than likely will not see any monies. That was 10 years ago so perhaps you should cut your losses and contact the social welfare and see where you stand if you leave the job (your employer has breached the contract) are to claim social welfare.

As the previous poster has mentioned dont go into work until you are satisfied iwth the outcome.

Yes you will get given out to for this "advice"! Because doing this would be grounds for instant dismissal and then the OP would be screwed.

OP - contact NERA today, they are extremely helpful.
